These Terms of Service ("Terms") form a binding agreement between you and QRFancy regarding your use of the Service. By creating an account or using the Service you accept these Terms. If you do not agree, do not use the Service.
1. The Service
QRFancy provides tools to design QR codes, host dynamic short links, capture scan analytics, build landing pages, and order printed merchandise. Features may be added, changed or removed over time.
2. Eligibility & accounts
- You must be at least 16 years old (or the age of digital consent in your country).
- You are responsible for keeping your credentials secure and for all activity under your account.
- You must provide accurate registration information and keep it up to date.
3. Plans, billing and refunds
- Paid plans renew automatically until cancelled. You can cancel at any time from the dashboard; access continues until the end of the paid period.
- Prices are shown in USD unless otherwise stated. Taxes are calculated at checkout.
- Print products are non-refundable once submitted to fulfilment, except where required by law (e.g. EU 14-day right of withdrawal for non-personalised goods).
- We may offer a refund at our discretion if the Service is materially broken for you.
4. Acceptable use
You must comply with our Acceptable Use Policy. In short: no illegal content, no malware, no phishing, no spam, no infringement of others' rights. We may suspend or terminate accounts that violate these rules without notice.
5. Your content
You retain ownership of everything you upload (designs, destinations, lead-capture data, AI prompts, artwork). You grant us a worldwide, non-exclusive licence to host, store, process and display your content solely to operate the Service. You represent that you have the rights necessary to grant this licence.
6. AI-generated artwork
AI features are powered by third-party models. Generated images may not be unique, may resemble other outputs, and ownership of AI output varies by jurisdiction. You are responsible for ensuring you have the right to use any output you publish, and for not submitting prompts that infringe third-party rights.
7. Intellectual property
The Service itself, including the QRFancy name, logo, code and templates, is owned by QRFancy and protected by copyright and trademark law. We grant you a limited, revocable, non-transferable licence to use the Service in accordance with these Terms.
8. Service availability
We aim for high availability but do not guarantee that the Service will be uninterrupted or error-free. Scheduled maintenance, third-party outages and force-majeure events may cause downtime. SLAs, where offered, are documented in your plan.
9. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, QRFANCY'S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) USD 100. WE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR LOST PROFITS, REVENUE OR DATA.
Nothing in these Terms limits liability that cannot be limited by law (such as fraud, gross negligence or death/personal injury caused by negligence).
11. Indemnity
You agree to indemnify and hold QRFancy harmless from claims arising out of (a) your content, (b) your use of the Service in violation of these Terms or applicable law, or (c) your infringement of any third-party right.
12. Termination
You can stop using the Service and delete your account at any time. We can suspend or terminate access if you breach these Terms. On termination, sections that by their nature survive (IP, disclaimers, liability, indemnity, governing law) will remain in effect.
13. Changes
We may update these Terms. Material changes will be communicated by email or in-product notice at least 30 days in advance. Your continued use of the Service after the effective date constitutes acceptance.
14. Governing law
These Terms are governed by the laws of Delaware, USA, without regard to its conflict-of-laws rules. Disputes will be resolved in the state or federal courts located in Wilmington, Delaware, except where mandatory consumer-protection rules in your country require otherwise.
